Multi-jurisdictional Litigation Practice
Successes involving multinational clients in 2007 include:
- obtaining an important victory on behalf of the Central Bank of Argentina (BCRA) in the U.S. Court of Appeals for the Second Circuit in ongoing litigation under the Foreign Sovereign Immunities Act, in which creditors of the Republic of Argentina sought to attach BCRA’s reserves at the New York Fed;
- achieving a major victory in the Second Circuit on behalf of First Manhattan, in a decision holding that the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) does not preempt state corporation law; and
- representing SCOR SE, a French reinsurance company, in litigation initiated in Massachusetts by Highfields Capital, a Boston hedge fund, in connection with a 2001 investment by Highfields in a joint venture with SCOR. We successfully argued for the dismissal of Highfields’ claim for punitive damages in 2007, and are currently preparing the remainder of the case for trial.
